Special Licence
A Special License entitles the holder of an On or Club licence to sell liquor beyond their existing licence conditions for a particular occasion or event.
This is a guide to the process involved in applying for a Special Licence pursuant to the Sale of Liquor Act. Please note that the suggestions contained in this document are intended as a guide only.
A Special Licence shall authorise the holder of the licence to sell and supply liquor, on the premises or conveyance described in the licence, to any person attending any occasion or event or series of occasions or events as described. It also allows a holder of an on-licence or club licence from time to time to sell and supply liquor for consumption on the premises when the premises are required to be closed for the sale of liquor, to persons attending social gatherings.
The Application
1. Every application for a special licence shall:
(a) Be made in the name of the person who will hold the licence if the application is granted; and
(b) Be made in the prescribed form and manner; and
(c) Contain the prescribed particulars; and
(d) Be accompanied by the prescribed fee
2. An application in respect of any premises shall be made to the District Licensing Agency for the
district in which the premises are situated.
3. An application in respect of any conveyance shall be made to the District Licensing Agency for the
district in which the applicant's principal place of business is situated.
4. Within 10 working days after filing the application, the applicant must, if required to do so by the
Secretary (of the DLA), ensure that notice of the application, in the prescribed form is attached in
a conspicuous place on or adjacent to which the application relates, unless the Secretary agrees
that it is impractical or unreasonable to do so.
Once the application is lodged, the Kaikoura District Licensing Agency will then refer the application to the Kaikoura Police and Liquor Licensing Inspector for reports. If no adverse reports or objections are obtained, the Agency will issue a decision accordingly (this may include changes to conditions of the licence). If, however, there are adverse reports the Agency will forward the application to the Liquor Licensing Authority (this process may take several weeks).
Applications for a special licence must always include a floor plan of the proposed licensed area and the written permission of the landowner, assuming the applicant is not the landowner.
